All your documentation becomes public information and can be accessed by many people when you go to court. Anyone could enter the courtroom and listen to your personal and financial information being discussed when your case is argued in front of a judge.

For many people having their personal information aired in public is uncomfortable. In nasty divorces when every “dirty deed” is being debated it can become ugly and embarrassing.

Having a public forum for your separation may not be ideal if you are self-employed, involved in a family business, or work in a corporation where privacy is important.

The advantage of mediation is the exchange of information is limited and not available for public access. At most, your information will be shared with your spouse, 2 lawyers who are bound by confidentiality, and a mediator who is also bound by confidentiality.
